Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Trieste Labs LLC (“Trieste Labs,” “we,” “us”), a Washington limited liability company, and govern your use of the Brioche mobile application, the websites getbrioche.app and invite.getbrioche.app, and related services (together, the “Services”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the permission of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use.

2. Your account

The app uses Sign in with Apple to create your account. You are responsible for activity on your account and for keeping your device and Apple ID secure. You may delete your account at any time in the app (Settings) or by contacting us; deletion removes your account and data as described in our Privacy Policy.

3. Households and shared lists

Brioche is built for sharing. When you join or create a household, other household members can see and edit lists shared with the household, including items you add. When you invite someone, the contents of shared lists become visible to them once they join. The household owner may remove members; leaving or being removed from a household ends your access to its shared lists. Do not add content to a shared list that you are not comfortable sharing with the whole household.

4. Subscriptions and billing

Brioche requires an auto-renewing subscription, purchased through the Apple App Store. Apple is the merchant of record: payment is charged to your Apple ID, and we never receive or store your payment details. The price and available plans (monthly or annual) are shown in the app and in the App Store before you subscribe.

  • Free trial. New subscribers get a 7-day free trial. If you do not cancel at least 24 hours before the trial ends, the subscription starts and your Apple ID is charged. Trial eligibility is determined by Apple and is generally limited to one introductory offer per Apple ID.
  • Auto-renewal. Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Renewal is charged to your Apple ID within 24 hours before the current period ends.
  • Cancellation. You cancel through the App Store, not in the app: on your device, go to Settings → your Apple ID → Subscriptions (or manage subscriptions in the App Store app). Deleting the app does not cancel your subscription. Cancellation takes effect at the end of the current billing period, and refunds are handled by Apple under its policies.
  • One subscription per household.A single subscription covers your whole household: the household owner pays, and invited members get full access at no charge, without a purchase or trial of their own. Members' access depends on the owner's subscription remaining active; if it lapses, shared features are restricted until the owner renews.
  • Price changes. If prices change, Apple will notify you as required and, where required, ask you to consent before the new price applies.

5. Your content

You own the content you put into the Services, such as your shopping lists, items, store names, and messages you send us. You grant us a limited, non-exclusive license to host, store, sync, transmit, and process that content solely to operate, improve, and support the Services — including the processing by service providers and AI providers described in our Privacy Policy. This license ends when your content is deleted from the Services, except as described in the Privacy Policy (for example, limited retention in backups).

6. AI features

Some features use artificial intelligence — for example, turning what you say or type into structured list items, and reading prompts aloud. AI output can be wrong: items may be misheard, misspelled, mis-categorized, or assigned to the wrong store. The AI features are conveniences, not guarantees, and we do not warrant the accuracy of their output. Review your lists before relying on them.

7. Location-based reminders

If you enable store reminders, the app uses your device’s location to notify you near stores you have saved. These notifications are best-effort: iOS may delay or skip them, and they can be affected by device settings, battery, or signal. Do not rely on Brioche for anything safety-critical or time-critical, and never interact with the app while driving. You can turn location access off at any time in your device settings.

8. Acceptable use

You agree not to:

  • use the Services for anything unlawful;
  • misuse invites, the waitlist, or the support form (including submitting other people’s email addresses or automating submissions);
  • probe, scrape, overload, or disrupt the Services, or attempt to access another user’s data;
  • reverse engineer or copy the Services except where the law permits it; or
  • resell or commercially exploit the Services without our consent.

9. Third-party services

The Services depend on third parties, including Apple (Sign in with Apple, notifications, speech), Google Maps Platform (store search — by using store search you also agree to the Google Terms of Service), Anthropic and ElevenLabs (AI features), RevenueCat (subscription management), Supabase, PostHog, Resend, Slack, Cloudflare, and Logo.dev and Google (store logos). We are not responsible for third-party services, and their availability may affect the Services.

10. The website and waitlist

The getbrioche.app website provides information about Brioche, a waitlist, and a support form. Joining the waitlist does not guarantee access to the app, a launch date, or any particular pricing, and we may change or discontinue the waitlist at any time.

11. Privacy

Our Privacy Policy describes what data we collect and how we use, share, retain, and delete it. It is part of these Terms.

12. Termination

You may stop using the Services or delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Services; where reasonable we will give you notice. Sections 5 and 13–17 survive termination.

13. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any content (including AI output and reminders) will be accurate or delivered.

14. Limitation of liability

To the fullest extent permitted by law, Trieste Labs will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for all claims relating to the Services is limited to the greater of fifty US dollars ($50) or the amounts you paid us for the Services in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold Trieste Labs harmless from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Services, or your violation of these Terms or of someone else’s rights.

16. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in King County, Washington, and you consent to their jurisdiction — except that either party may bring an eligible claim in small-claims court.

17. App Store

The Brioche app is distributed through the Apple App Store and is licensed to you, not sold, under Apple’s Licensed Application End User License Agreement. These Terms govern the Services themselves. Apple is not a party to these Terms and has no obligation to provide support or maintenance for the app.

18. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the current version, and we will notify you of material changes in the app or by email. Continuing to use the Services after changes take effect means you accept the updated Terms.
